    Terms of Service

    These Terms of Service ("Terms") govern your use of the Your Presence website, subscription services, website development services, and related services provided by Your Presence LLC ("Your Presence," "we," "us," or "our"). By purchasing, accessing, or using our services, you ("Customer," "you," or "your") agree to these Terms. Please read them carefully.

    Acceptance of Terms

    By accessing our website, purchasing a subscription, submitting an order, or using our services, you agree to be bound by these Terms of Service and any policies or terms incorporated into them.

    If you do not agree with these Terms, you may not purchase or use our services.

    If you are purchasing services on behalf of a business or other organization, you represent that you have authority to enter into this agreement on behalf of that organization.

    Our Services

    Your Presence provides website design and development, website hosting, search engine optimization, ongoing website updates, performance and lead tracking, website maintenance, marketing-related services, and related support primarily for home-service businesses.

    The specific services, features, and limitations included with your account depend on the subscription plan, order, proposal, or other service arrangement you select.

    Certain services may depend on third-party providers, platforms, software, integrations, hosting infrastructure, domain registrars, telecommunications providers, search engines, advertising platforms, or other external services.

    Website Development & Delivery

    Your Presence provides website development and related services electronically. No physical product is shipped.

    Unless otherwise stated in writing, our standard target is to deliver the initial version of your website within seven (7) business days after all information and requirements reasonably necessary to begin the project have been received.

    The seven-business-day period begins only after Your Presence has received the information, materials, credentials, access, and other items reasonably required to begin development.

    Delivery of the "initial version" means that a substantially complete version of the website has been made available to the Customer for review, approval, or publication. It does not necessarily mean that all requested revisions, future enhancements, third-party integrations, search-engine indexing, marketing campaigns, or ongoing services have been completed.

    7-Business-Day Delivery Guarantee

    We stand behind our ability to build websites quickly.

    Subject to the conditions below, Your Presence guarantees delivery of the initial version of your website within seven (7) business days.

    To qualify for the 7-Business-Day Delivery Guarantee, you must remain reasonably engaged throughout the development process and respond to requests from Your Presence for information, content, credentials, access, feedback, selections, or approvals within twenty-four (24) hours of our request.

    If we are waiting on information, materials, access, feedback, approval, or another required response from you for more than 24 hours, the delivery timeline will be paused until the requested information or response is received. The remaining delivery period will resume after we receive what is reasonably required to continue the project.

    If Your Presence fails to deliver the initial version of your website within seven business days for reasons solely attributable to Your Presence, and you have satisfied the requirements of this section, Your Presence will waive or credit an amount equal to one monthly subscription fee for the affected website subscription.

    In other words, if we cause the qualifying delay, your next applicable month of website service is on us.

    This credit is the exclusive remedy provided under the 7-Business-Day Delivery Guarantee.

    The guarantee does not apply to delays caused by or resulting from circumstances outside the reasonable control of Your Presence, including customer delays; incomplete or inaccurate information; delayed approvals; failure to provide credentials or account access; requested changes to project scope; domain transfers; DNS propagation; domain registrars; hosting providers; third-party software or integrations; search engines; advertising platforms; telecommunications providers; internet outages; acts of government; force majeure events; or other third-party services or circumstances beyond our reasonable control.

    Your Presence may, at its discretion, provide additional credits, refunds, accommodations, or other remedies when we believe circumstances warrant them.

    Customer Cooperation

    Our ability to deliver your website and provide ongoing services depends in part on your cooperation.

    You agree to provide accurate and reasonably complete information about your business and to provide requested content, branding, photos, credentials, approvals, and other materials necessary to perform the services.

    You are responsible for reviewing information provided to Your Presence and notifying us of material inaccuracies.

    Delays caused by missing information, unavailable access, delayed approvals, or failure to respond to communications may delay delivery and are not considered a failure by Your Presence to perform the services within a stated timeframe.

    Subscriptions & Recurring Billing

    Unless otherwise expressly stated, Your Presence website plans and other subscription services are billed on a recurring monthly basis.

    By purchasing a recurring subscription, you authorize Your Presence LLC and its payment processors to charge the payment method you provide for the applicable subscription amount at the time of purchase and on a recurring monthly basis thereafter until the subscription is canceled.

    The price and billing frequency applicable to your subscription will be disclosed before purchase.

    Your subscription automatically renews each billing period unless canceled in accordance with these Terms.

    You are responsible for maintaining a valid payment method and accurate billing information.

    If a payment fails, we may retry the payment method, request an updated payment method, suspend services, restrict access, or take the website offline until the account is brought current.

    We may change subscription pricing upon reasonable advance notice. Unless otherwise stated, pricing changes will apply to a future billing cycle rather than retroactively to amounts already paid.

    Cancellation Policy

    You may cancel your monthly subscription at any time.

    Unless otherwise stated in writing, cancellation becomes effective at the end of the billing period for which you have already paid. Cancellation prevents subsequent recurring subscription charges but does not ordinarily result in a refund of fees already paid.

    Cancellation requests should be submitted through any cancellation functionality we make available or by contacting us at hello@getyourpresence.com.

    You remain responsible for charges incurred before the effective date of cancellation.

    Once a subscription terminates, services associated with that subscription may cease, including website hosting, maintenance, updates, tracking, software access, and other subscription-based services.

    Your website may be taken offline following termination unless separate arrangements have been made with Your Presence.

    Refund Policy

    Because Your Presence provides customized digital services and may begin allocating resources, performing research, configuring accounts, developing content, designing pages, and performing other work shortly after an order is submitted, payments are generally non-refundable once work has begun, except where required by applicable law or expressly provided by these Terms.

    A customer's decision to cancel a subscription does not, by itself, create a right to a refund for a billing period that has already begun or services that have already been performed.

    If Your Presence makes a material error or fails to provide a purchased service as described, please contact us at hello@getyourpresence.com so we can review the situation.

    Depending on the circumstances, Your Presence may correct or reperform the affected service or, at our discretion, provide an account credit, waive a future payment, or issue a partial or full refund.

    The 7-Business-Day Delivery Guarantee is governed by the separate provisions above. When the requirements of that guarantee are satisfied, the Customer is entitled to the service credit described in that section.

    Approved monetary refunds will ordinarily be returned to the original payment method. The time required for the refund to appear in your account may depend on your bank, card issuer, payment network, or payment processor.

    Nothing in this Refund Policy limits any rights that cannot legally be waived under applicable law.

    Revisions & Ongoing Website Updates

    If ongoing website updates or revisions are included in your subscription, Your Presence will perform reasonable update requests consistent with the scope of your plan.

    Website updates generally include modifications to an existing website, such as changing text, images, contact information, services, service areas, calls to action, and similar website content.

    Requests that substantially change the original scope of the website, require extensive custom development, create significant new functionality, involve third-party costs, or effectively constitute a new website or major redesign may fall outside your subscription.

    If additional fees are required, Your Presence will communicate those fees before performing the additional paid work.

    Your Responsibilities

    You agree to use our services lawfully and to provide accurate information regarding your business.

    You are responsible for the legality, accuracy, ownership, licensing, and appropriateness of materials you provide to us, including business information, trademarks, logos, photographs, videos, written content, testimonials, claims, licenses, certifications, and other materials.

    You represent that you have the necessary rights or permissions for materials you instruct us to use.

    You are also responsible for reviewing your website and notifying us of errors, inaccurate information, or content that should be changed.

    Website Content & Ownership

    You retain ownership of your business name, trademarks, branding, logos, photographs, videos, and original content that you provide to Your Presence.

    Unless otherwise agreed in writing, Your Presence retains ownership of its underlying website frameworks, templates, design systems, software, code, processes, automation, proprietary tools, reusable components, methodologies, and other intellectual property used to provide the services.

    While your applicable subscription remains active and in good standing, you receive the right to use the website and services provided under your subscription.

    Third-party software, fonts, photographs, plugins, integrations, stock assets, and other third-party materials remain subject to their respective licenses and ownership terms.

    Domains & Third-Party Accounts

    Domain names, Google Business Profiles, advertising accounts, social media accounts, analytics accounts, and other third-party assets may be governed by separate terms imposed by their respective providers.

    Where Your Presence assists with configuring or managing such assets, we do not control the policies, availability, approval processes, suspensions, algorithms, or technical operation of those third parties.

    You are responsible for complying with the applicable terms and policies of third-party services used in connection with your business.

    Search Engine Optimization & Marketing

    Search engines, advertising platforms, directories, and other third-party platforms determine their own rankings, placement, eligibility, pricing, algorithms, and policies.

    Your Presence may perform search engine optimization, marketing, lead tracking, content optimization, and related services, but we do not control Google or any other search engine or advertising platform.

    Accordingly, we do not guarantee any particular search-engine ranking, traffic level, advertising placement, number of leads, calls, estimates, booked jobs, sales, or revenue.

    No Performance Guarantees

    Your Presence works to improve your online presence and help your website generate business opportunities. However, business results depend on numerous factors outside our control.

    Except for an expressly stated written guarantee such as the 7-Business-Day Delivery Guarantee, we make no guarantee regarding search rankings, website traffic, lead volume, telephone calls, form submissions, estimates, appointments, customers, revenue, profitability, or other business outcomes.

    Past results, examples, case studies, projections, or estimates do not guarantee future performance.

    Acceptable Use

    You may not use our services for unlawful, fraudulent, deceptive, abusive, or malicious purposes.

    You may not use the services to violate the intellectual-property, privacy, publicity, or other rights of another person; distribute malware or harmful code; interfere with our infrastructure; attempt unauthorized access; or engage in conduct that could reasonably damage Your Presence, our systems, our providers, or other customers.

    We reserve the right to suspend or terminate services for violations of these Terms or activities that create material legal, security, reputational, or operational risk.

    Service Availability

    We strive to maintain reliable service availability, but we do not guarantee uninterrupted or error-free operation.

    Websites and related services may occasionally become unavailable because of maintenance, software issues, internet disruptions, hosting infrastructure, cyberattacks, third-party outages, domain or DNS problems, or circumstances outside our reasonable control.

    Your Presence is not responsible for temporary outages or service interruptions caused by third parties or events outside our reasonable control.

    Payment Disputes & Chargebacks

    If you believe a charge from Your Presence is incorrect, we ask that you contact us at hello@getyourpresence.com before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue.

    Initiating a chargeback does not automatically terminate a subscription or eliminate amounts legitimately owed under these Terms.

    We reserve the right to provide payment processors, financial institutions, and card networks with relevant records concerning a disputed transaction, including order information, these Terms, customer communications, service records, website-development records, login or access information where appropriate, delivery records, and other evidence reasonably necessary to respond to the dispute.

    We may suspend services associated with an account when payments are reversed, disputed, fraudulent, or materially past due, subject to applicable law and payment-network requirements.

    Termination

    Either party may terminate a subscription as provided in these Terms.

    Your Presence may suspend or terminate services immediately if you materially violate these Terms, engage in unlawful or abusive activity, fail to pay amounts due, create an unreasonable security or legal risk, or misuse our services.

    Upon termination, your right to use subscription-based services may end, and your website may be taken offline unless otherwise agreed in writing.

    Provisions that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, and dispute-related provisions—will survive termination to the extent permitted by law.

    Disclaimer of Warranties

    Except for warranties or guarantees expressly stated in these Terms, our services are provided "as is" and "as available" to the fullest extent permitted by applicable law.

    Your Presence disclaims implied warranties to the extent they may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

    Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

    Limitation of Liability

    To the fullest extent permitted by applicable law, Your Presence LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost leads, loss of data, loss of goodwill, or lost business opportunities arising out of or related to the services.

    To the fullest extent permitted by applicable law, the aggregate liability of Your Presence arising out of or relating to the services or these Terms will not exceed the amount actually paid by the Customer to Your Presence for the applicable service during the three (3) months immediately preceding the event giving rise to the claim.

    The limitations in this section apply only to the extent permitted by applicable law.

    Changes to These Terms

    We may update these Terms of Service from time to time to reflect changes in our services, pricing, business practices, legal obligations, or other circumstances.

    When we make changes, we will post the revised Terms and update the "Last Updated" date.

    Where required by law, we will provide additional notice of material changes.

    Continued use of the services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
